Synopsis: Notice of Intent to Award a Sole-Source Contract



Announcement Number: 141013-24-0012



Project Title: AB Sciex Mass Spectrometers Service and Maintenance



The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Acquisition Division-Norfolk, VA office, Simplified Acquisition Branch intends to negotiate on a sole source basis, under the statutory authority of FAR 13.106-1(b)(1)(i), with Sciex Service Advantages, for the maintenance and repair of three AB Sciex mass spectrometers. This requirement includes a base and one option year. The North American Industry Classification Code (NAICS) for this acquisition is 811210, Electronic and Precision Equipment Repair and Maintenance; with a size standard of $34.0 million.



Sole Source Justification



Sciex Service Advantages are vital to the quantitative and qualitative analysis of samples for a variety of harmful algal toxins. Having these instruments operational and functional is an essential component for the fulfilment of analyses supporting the harmful algal bloom monitoring and reference branch. Only Sciex trained and certified technicians are capable of providing the services required at the level of quality required because the services are unique and highly specialized. Sciex is the sole source provider of Sciex Service Advantages authorized training for service representatives. In addition, Sciex is the sole source for factory-recommended replacement parts, proprietary factory recommended upgrades (hardware and software), and service notes. Allowing any contractor other than Sciex authorized providers to perform maintenance on these scientific instruments will void any warranty, and will greatly increase the risk of damage to this equipment.



Special Notice



This special notice is not a solicitation for competitive quotes, nor will one be posted on Contract Opportunities. However, if an interested party believes that it is capable of meeting the requirements and be in compliance with the above justification, they may submit substantiating documentation in writing within the open period of this notice. Responses can be sent via e-mail to tia.palmer@noaa.gov. Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice.



All responsible sources may submit a Capability Statement in accordance with the solicitation, which shall be considered by the agency if received on or before 11:00 AM EST on February 21, 2024. The Capability Statement must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
