The Agency hereby provides notice that it intends to enter into a sole source contract per S.C. Code Ann. §11-35-1560 with Vendor for the following supplies, services, information technology, or construction:

Clemson University is seeking a second camera-based system for the digitization of cultural heritage materials. We require an all-in-one system (camera, lens, lights, copy stand, and software designed to work together) that can effectively and efficiently capture a wide variety of materials (including documents, photographs, bound objects, and oversized items). The system must be able to deliver FADGI 4-star level images. We need this system to be able to auto-focus, automatically adjust to different resolution settings, and the software needs to have auto crop capabilities in order to both meet the production demands on the department and so that the system can be used by student employees (not professional imaging specialists). We also need a system that does not require a tech-support maintenance contract for the ongoing maintenance of the system. Digital Transitions is the only vendor on the market that sells an all-in-one camera-based capture system designed for cultural heritage materials that meets all of the above requirements. The Phase One iXH camera paired with the DT Versa copy stand, DT Photon XL lights, and Capture One Cultural Heritage software are all designed to work together for ease of use in a production environment and to achieve the highest quality images. Digital Transitions is the sole source provider of the DT Versa, the DT LED Photon Lights, the Capture One Cultural Heritage software, and the Phase One iXH in the United States, as discovered during inquiry of additional suppliers outside of the US and their response that they are not permitted to sell in the North American territory.

PROTESTS:
Any actual or prospective bidder, offeror, contractor, or subcontractor aggrieved in connection with the intended award or award of this sole source contract, shall notify the appropriate chief Procurement officer in writing of its intent to protest within five (5) business days of the date this notice is posted. Any actual or prospective bidder, offeror, contractor, or subcontractor who is aggrieved in connection with the intended award or award of this sole source contract and has timely notified the appropriate chief procurement officer of its intent to protest, may protest to the appropriate chief procurement officer in the manner set forth below within fifteen days of the date this notice is posted; except that a matter that could have been raised as a protest of the solicitation may not be raised as a protest of the award or intended award of a contract.
A protest must be in writing, filed with the appropriate chief procurement officer, and set forth the grounds of the protest and the relief requested with enough particularity to give notice of the issues to be decided. The protest must be received by the appropriate chief procurement officer within the time provided above. Days are calculated as provided in S.C. Code Ann. §11-35-310(13).
